Terms and Conditions of Sale

1. Purpose
These Terms and Conditions of Sale govern the sale of digital products on the website breathprofile.com, published by COLLIE Simon, sole proprietor (SIRET: 98968159800029). Any order implies unreserved acceptance of these Terms and Conditions.
2. Products
The products offered for sale are digital documents in PDF format: • Practical Protocol — A personalized breathing exercise guide based on the results of your breathing assessment. • Complete Bundle (Practical Protocol + Theoretical Guide) — The Practical Protocol accompanied by an in-depth theoretical guide on the science of breathing. These products are personalized based on the responses provided during the breathing assessment questionnaire.
3. Pricing
Prices are displayed in euros (€) inclusive of all taxes. As the seller is a sole proprietor (auto-entrepreneur), VAT is not applicable (article 293 B of the French General Tax Code). Current prices are: Practical Protocol: €19 — Complete Bundle: €35. The publisher reserves the right to modify prices at any time. The applicable price is the one displayed at the time of order validation.
4. Ordering
The user places an order by completing the breathing assessment questionnaire and then proceeding to payment on the checkout page. Payment validation constitutes acceptance of these Terms and Conditions and forms the sales contract.
5. Payment
Payment is made online by credit card via the secure Stripe platform. Payment is due immediately upon ordering. Payment data is processed directly by Stripe and is never stored on our servers. Stripe is PCI-DSS Level 1 certified, the highest level of certification in the payment industry.
6. Delivery
As the products are exclusively digital, delivery is made electronically. After payment confirmation, the customer immediately receives access to their personalized document via a download link on the website. A confirmation email containing the access link is also sent to the email address provided during ordering.
7. Right of Withdrawal
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of digital content not provided on a tangible medium, the performance of which has begun after the consumer's prior express consent and express waiver of the right of withdrawal. By validating your order and immediately accessing the content, you expressly acknowledge waiving your right of withdrawal. However, a voluntary commercial guarantee is offered (see Article 8).
8. Money-Back Guarantee
Regardless of legal provisions, COLLIE Simon voluntarily offers a 30-day money-back guarantee from the date of purchase. If you are not satisfied with your purchase, you may request a full refund by contacting contact@breathprofile.com within 30 days of your order. No justification is required.
9. Liability
The contents of the PDF documents are provided for informational and educational purposes only. They do not constitute medical advice and do not replace consultation with a healthcare professional. The publisher cannot be held liable for the use of information contained in the documents. If you have any doubts about your health, consult a doctor before practicing the proposed exercises.
10. Applicable Law
These Terms and Conditions are governed by French law. Any dispute relating to their interpretation and/or execution falls under the jurisdiction of the competent French courts.
11. Dispute Resolution
In the event of a dispute, the customer is invited to first contact the seller at contact@breathprofile.com to seek an amicable solution. In accordance with Articles L611-1 et seq. of the French Consumer Code, the consumer may use a consumer mediator free of charge for the amicable resolution of the dispute.
